Who Must File Form 2290?

Any business or individual operating a commercial truck, tractor, or bus with a taxable gross weight of 55,000 lbs or more on public highways must file Form 2290. That includes large trucking fleets, small regional carriers, and owner-operators running a single truck. There's no exemption based on fleet size.

Two mileage-based exemptions exist. Vehicles that travel 5,000 miles or fewer during the tax year (7,500 miles for agricultural vehicles) are considered suspended vehicles and owe no tax. They still require a Form 2290 filing, just with a $0 liability. If a suspended vehicle later exceeds the mileage threshold, HVUT becomes due at that point.

How Is the Heavy Vehicle Use Tax Calculated?

HVUT is calculated based on the vehicle's taxable gross weight. The base rate starts at $100 for vehicles weighing between 55,000 and 56,000 lbs, with an additional $22 for each 1,000 lbs (or fraction thereof) over 55,000 lbs. The tax caps at $550 per vehicle per year for vehicles over 75,000 lbs.

For a fleet, the total HVUT liability is calculated vehicle by vehicle, which means a large fleet can carry a substantial annual tax bill. Suspended vehicles are listed on the return but calculated at $0.

Form 2290 Filing Deadline

The Form 2290 tax year runs July 1 through June 30. For vehicles first used in July, the filing deadline is August 31. For vehicles first put into service in any other month, the deadline is the last day of the month following the first month of use. A truck first used in November, for example, has a December 31 filing deadline for that vehicle.

This rolling deadline structure means fleet operators who add vehicles throughout the year have multiple filing obligations, not just one annual event in August.

The Schedule 1 Stamped Proof of Payment

After filing Form 2290 and paying the HVUT, the IRS returns a stamped Schedule 1 as official proof of payment. This document is required for commercial vehicle registration at the DMV and is frequently checked at weigh stations. Without it, a vehicle can't be legally registered.

Businesses that e-file receive a watermarked Schedule 1 within minutes of the IRS accepting the return, which is one of the main practical reasons e-filing has become the standard. Paper filers wait weeks for the stamped copy to arrive by mail, which can delay registration for new vehicles.

Form 2290 for Owner-Operators and Small Fleets

There is no small fleet exemption and no single-truck exemption. An owner-operator running one truck over 55,000 lbs must file Form 2290 the same as a carrier running 500 vehicles. The only structural difference is that e-filing is mandatory for businesses with 25 or more vehicles. Owner-operators and small fleets can file by mail or through any IRS-authorized e-file provider.

For owner-operators, the August 31 deadline tends to land at the same time as other operating expenses, and the HVUT payment is due in full at filing. Planning for it as a fixed annual expense rather than treating it as a surprise bill makes it easier to absorb.
